DAVID M. FELDMAN

Mr. Feldman’s practice focuses on the representation of both public and private sector employers in all forms of labor and employment disputes, school districts and other public entities in civil rights litigation, and general litigation.  He also serves as the school attorney for a wide variety of Houston area school districts, and outside general counsel to various other public entities.  He has had extensive trial experience in state and federal court (both jury and non-jury cases), before administrative agencies, and substantial state and federal appellate experience.  Mr. Feldman is Board Certified in Labor and Employment law by the Texas Board of Legal Specialization and he serves as Chairman of the Labor and Employment Law Advisory Commission to that Board.  He is the author of Teacher Organizations in Texas A Labor Relations Guidebook, published by the Texas Association of School Boards, as well as law journal articles dealing with various areas of employment and civil rights law.  He has been a guest speaker in seminars and workshops for legal organizations, school board associations and various private and public employer groups.  He has also served as Chair of the ABA sub-committee on Public Sector Equal Opportunity Law and was selected for inclusion in Best Lawyers in America (The American Lawyer), Texas Top-Notch Lawyers (The Texas Lawyer), and Texas Super Lawyers (The Texas Monthly).  Mr. Feldman has taught at the University of Houston and has served as an Adjunct Lecturer in Labor, Employment and Administrative Law at South Texas College of Law.  He is AV rated by Martindale-Hubbell. 
 

Prior to founding the Firm in 1993, Mr. Feldman was a partner with Vinson & Elkins LLP  and was in charge of that firm's public sector labor law and school law practice. 
 

Education and Honors
Mr. Feldman received his B.S. from Louisiana State University in 1970, and received his J.D., summa cum laude, from South Texas College of Law in 1976.  He also served as an Infantry Officer in the U.S. Army from 1970 to 1972.  Mr. Feldman is admitted to practice before the U.S. Supreme Court; U.S. Court of Appeals, Fifth and Eleventh Circuits; U.S. District Court, Southern, Eastern, Northern and Western Districts of Texas.

JEFFREY L. ROGERS

Mr. Rogers heads the Firm’s special education law practice.  He also has extensive experience with employment matters (public and private) and has handled virtually all types of litigation involving school districts.  He has considerable experience in state and federal court, before administrative agencies, and substantial appellate experience.  He is a frequent presenter on the subject of special education law.  He currently serves as the Firm’s managing partner.

 

Mr. Rogers worked as both an associate (1980-85) and partner (1985-88) with Reynolds, White, Allen & Cook.  In 1988 he joined the firm of Brown, Parker & Leahy, L.L.P. and on May 1, 1996, he joined David M. Feldman in partnership.

 

Education and Honors
Mr. Rogers received his Bachelor of Journalism degree from the University of Texas at Austin in 1975, and his J.D. degree from South Texas College of Law in 1980 (where he was on the Dean’s Honor List all 3 years and received the E.E. Townes Award for Scholastic Excellence from 1979-80).  Mr. Rogers is admitted to practice before the U.S. Supreme Court; U.S. Court of Appeals, Fifth Circuit; U.S. District Court, Southern, Eastern, Northern and Western Districts of Texas.

RICHARD A. MORRIS

Mr. Morris represents both public and private sector clients, advising them on a wide range of legal matters, including personnel issues, employee grievances and terminations, employment contracts, student discipline, construction, competitive bidding and policy development.  His practice also includes representation of public and private sector clients in a wide variety of litigation, including civil rights, employment and construction litigation.  He has had extensive trial experience in state and federal court (both jury and non-jury cases), before administrative agencies, and substantial state and federal appellate experience. He has been peer reviewed by Martindale-Hubbell, receiving an AV rating, which denotes the highest rating in legal ability and ethical standards and was selected for inclusion in Texas Super Lawyer: Rising Stars (2004) and Texas Super Lawyer (2009).  Mr. Morris served as an adjunct professor of appellate advocacy at South Texas College of Law from 1991 to 2000.
 

Mr. Morris began his legal career working at Vinson & Elkins, L.L.P. in its Business Litigation Section.  He joined David Feldman in practice in 1993 and became a partner in the firm in 1997.

Mr. Morris is admitted to practice before the U.S. Supreme Court; U.S. Court of Appeals, Fifth Circuit; U.S. District Court, Southern, Eastern, Northern and Western Districts of Texas.


Education and Honors
Mr. Morris received his Bachelor of Journalism degree from the University of Texas at Austin in 1988, and graduated summa cum laude from South Texas College of Law in 1991 where he served on the school’s law review and was a member of both the Order of the Lytae and Order of Barristers.  He was also a Langdell Scholar and a recipient of the Alumni Association’s Honor Scholar Award and the Houston Hispanic Bar Association’s De Anda Scholarship.  In law school, he competed as a member of several national moot court teams, including the winning team of the American Bar Association’s National Moot Court Championship (1990), winning awards both as an oralist and brief writer.

CLAY T. GROVER

Mr. Grover’s practice focuses on the representation of both private and public sector employers in all forms of labor, employment and civil rights matters.  Mr. Grover has trial experience in both state and federal courts and has successfully defended claims under the Fair Labor Standards Act, Title VII, the Americans With Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, the Texas Commission on Human Rights Act, and other statutory and common law claims, including wrongful termination, workers compensation retaliation and various tort claims.  Mr. Grover also has significant experience defending governmental entities and public officials from civil rights claims, whistleblower claims, and other causes of action unique to the public sector.

Education and Honors
Mr. Grover received his B.A. from Southwest Texas State University in 1987, and received his J.D. from South Texas College of Law in 1991.  While in law school, Mr. Grover was a member of the South Texas Law Review, recipient of the American Jurisprudence Award and was on the Dean’s List.

ROBERT A. SCHULMAN

Mr. Schulman is the Managing Partner of the Firm's San Antonio office, and has been representing nonprofit, corporate and public entity clients in employment and civil litigation for 35 years.  His current client list includes charter schools, private schools, public school districts and other public, private and nonprofit entities in Dallas, Austin, San Antonio, El Paso, Del Rio and surrounding areas.

Mr. Schulman was a founder and partner with the education law firm of Schulman, Walheim & Heidelberg (1979-99). He became a partner, shareholder and manager of the San Antonio office of the education law firm, Schwartz & Eichelbaum (1999-2002) and subsequently moved his attorneys and staff to Feldman, Rogers, Morris & Grover where he has achieved state-wide and national recognition for his experience, knowledge and successes in representing, school districts, nonprofit corporations operating Texas open-enrollment charter schools and other public and nonprofit agencies.

Education and Honors
Mr. Schulman practices before the U. S. Court of Appeals, Fifth Circuit, and U. S. District Courts (Southern, Northern and Western Districts of Texas).  His preparatory education was at St. Mary's University (B.A. 1968); his legal education at St. Mary's University School of Law (J.D. 1974). He was admitted to the Texas bar in 1975.

Mr. Schulman is a member of the San Antonio Bar Association, Texas Association of School Boards, State Bar of Texas (School Law Section), National Council of School Attorneys, Education Law Association, and Texas Association of Community College Attorneys.  He has written for the Texas Bar Journal and is often called upon as a presenter for professional conferences and gatherings.

PAUL A. LAMP

ELLEN H. SPALDING

Ms. Spalding’s practice focuses on all matters concerning public school districts across Texas, including governance, open government, personnel, students, contracts, elections, and litigation.  Ms. Spalding is a frequent speaker at school law conferences and conducts numerous trainings for school districts.  Ms. Spalding has also represented private entities in all aspects of employment including counseling and litigation.  Ms. Spalding has extensive experience practicing before state and federal courts, and is admitted to practice before all Texas Courts, as well as before U.S. District Courts in the Southern, Eastern, Northern and Western Districts of Texas and the Fifth Circuit Court of Appeals.

J. ERIK NICHOLS

Mr. Nichols' practice primarily involves the representation of school districts in a wide variety of matters including special education, personnel, student discipline, open government, board governance and contracts.  Mr. Nichols has a long history of successful representation of school districts before the federal and state courts (both jury and non-jury trials) and administrative agencies.  Mr. Nichols frequently conducts trainings for school districts with focuses on employment and personnel issues, student discipline and special education law.
 

Mr. Nichols, former shareholder and managing partner with the education law firm of Henslee, Fowler, Hepworth & Schwartz, L.L.P., joined Feldman & Rogers in 2007.

MICHELLE HERRMANN MORRIS

Ms. Morris's practice is focused in the areas of construction and real estate, including consultation through all phases of construction and land acquisition, preparation of construction and real estate contracts and related documents, public procurement law, contract negotiations, due diligence, land development and permitting; eminent domain/condemnation, construction and design disputes, surety claims, and mechanic's and materialman's liens.  Ms. Morris is admitted to practice before all Texas Courts, and is also admitted to practice before U.S. District Courts in the Southern and Eastern Districts of Texas, as well as the Fifth Circuit Court of Appeals.

RICARDO R. LOPEZ

Mr. Lopez’ practice focuses on all areas of school law, as well as litigation.  Mr. Lopez has defended school districts, charter school, other governmental entities and private employers from claims under state and federal constitutional claims, Title VII, the Age Discrimination in Employment Act, the Family Medical Leave Act, the Americans with Disabilities Act, the Texas Commission on Human Rights Act, workers’ compensation retaliation, the Texas Whistleblower Act, and state law tort claims.  Mr. Lopez also has extensive experience successfully representing clients in administrative matters before the Equal Employment Opportunity Commission, the Civil Rights Division of the Texas Workforce Commission, and the Office of Civil Rights.

Mr. Lopez has also successfully handled teacher termination cases arising under Subchapter F of Chapter 21 of the Texas Education Code.  Mr. Lopez also advises school boards on policy matters, and has both advised boards and represented school administration in all manner of grievance hearings arising under Board policy.

Mr. Lopez received his B.A. from Rice University in 1998, and received his J.D. from South Texas College of Law in 1999.  While in law school, Mr. Lopez was an Articles Editor on the South Texas Law Review, and an award-winning brief writer for the South Texas College of Law varsity Moot Court team.
